Tl* the contact owns a 2008 lincoln mkz. while driving 33 mph the brake pedal was depressed however, the brake failed to engage quickly causing the contact to rear end another vehicle. no warning lights were illuminated. the contact stated that the brake failure was an on going issue. no injuries were sustained and a police report was filed. the vehicle was taken to the an independent mechanic whom diagnosed the failure as the master cylinder however, the vehicle was not repaired. the vehicle was then taken to a dealer whom stated that the failure was not related to the master cylinder however, a failure cause was not diagnosed. the contact stated recently received notification of nhtsa campaign number: 19v904000 (service brakes, hydraulic) and the vehicle was taken to a dealer where the failure was diagnosed as being related to the recall. however, the parts were not available for the recall remedy. the manufacturer was notified of the failure but no assistance was offered. the contact was upset that the parts were not available for the recall remedy in a timely manner. the failure mileage was unknown. vin tool confirms parts were not available.

Letter from senator nelson re constituent regarding 2008 lincoln mkz ( reference constituent for their records). *smd the consumer stated slightly for more than a year, three safety warning lights illuminated on the dashboard. they were the traction-stability, abs, and brake warning lights. the first time the consumer returned to the dealer, they stated the computer did not detect any malfunction, and to bring the vehicle back, when the lights came back on. the lights would illuminate intermittently and without apparent cause, often all at once or individually and before, he could get to the dealer. the second time, the consumer took the vehicle back to the dealer, they were still unable to detect a problem. the third time, the consumer went to the dealer, he left the vehicle there. after two weeks of having the vehicle, the lights finally illuminated, while the vehicle was being test driving. after hooking the vehicle to the computer, the dealer found the problem, was the anti-lock brake module the consumer was informed the part would cost $700. however, it was agreed, the consumer would pay $200 of the expense as a deductible. the next day, the lights illuminated again. the consumer took a picture of the lights and returned to the dealer for a fourth time. the vehicle was at the dealer for a month, with no resolution.

The brake and gas pedals on my lincoln mkz are located so close to each other and at the same height that i have twice experienced acceleration instead of braking when putting on the brakes because i did not move my foot enough to clear the gas pedal. i have inquired to my dealer about making an adjustment to the brakes pedal height or spacing but was advised that this could not be done. this design is an "accident waiting to happen" and i am lucky that in both instances i was able to react in time to avoid one. if this has not already been brought to the attention of the manufacturer, nhtsa should do so before someone is seriously hurt. *tr
